Postanowienia ogólne

Niniejszy Regulamin określa zasady korzystania ze strony internetowej dostępnej pod adresem projektindie.pl (dalej: „Serwis"), prowadzonej przez AgBi w ramach działalności twórczej pod nazwą Projekt Indie.

Korzystanie z Serwisu oznacza akceptację niniejszego Regulaminu w całości. Osoby, które nie akceptują jego postanowień, proszone są o opuszczenie Serwisu.

Definicje

• Serwis — strona internetowa AgBi dostępna pod adresem projektindie.pl wraz ze wszystkimi podstronami.
• Użytkownik — każda osoba fizyczna, prawna lub jednostka organizacyjna odwiedzająca Serwis.
• Administrator — AgBi, prowadzący Serwis i odpowiedzialny za jego treść.
• Treści — wszelkie materiały tekstowe, graficzne, wideo i audiowizualne zamieszczone w Serwisie.
• Współpraca — odpłatna lub nieodpłatna działalność twórcza świadczona na rzecz podmiotów trzecich, opisana w Serwisie.

Zasady korzystania z Serwisu

Użytkownik zobowiązuje się do korzystania z Serwisu zgodnie z obowiązującym prawem, dobrymi obyczajami oraz niniejszym Regulaminem.

Zabrania się w szczególności:

• Kopiowania, powielania lub rozpowszechniania treści Serwisu bez pisemnej zgody Administratora.
• Podejmowania działań mogących zakłócić prawidłowe funkcjonowanie Serwisu.
• Scrapingu, automatycznego pobierania danych lub innego technicznego obchodzenia zabezpieczeń.
• Wykorzystywania Serwisu w celach komercyjnych bez uprzedniej zgody Administratora.
• Podszywania się pod Administratora lub Projekt Indie w przestrzeni publicznej.

Prawa autorskie i własność intelektualna

Wszelkie treści zamieszczone w Serwisie — w tym teksty, grafiki, logotypy, nagrania wideo, opisy, recenzje i analizy — stanowią własność intelektualną Administratora lub podmiotów, które udzieliły stosownych licencji, i podlegają ochronie na podstawie ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych.

• Dozwolone jest cytowanie fragmentów treści Serwisu z obowiązkowym podaniem źródła i autorstwa (AgBi / Projekt Indie).
• Opinie i recenzje gier zamieszczone w Serwisie wyrażają subiektywny punkt widzenia Administratora i nie mogą być traktowane jako materiał marketingowy bez pisemnej zgody.
• Logotypy i znaki graficzne deweloperów gier indie przywołanych w Serwisie są własnością ich odpowiednich właścicieli.

Współpraca i zapytania biznesowe

Administrator świadczy usługi twórcze na rzecz niezależnych studiów deweloperskich i wydawców gier, obejmujące m.in.:

• Tworzenie recenzji i analiz gier indie.
• Promocję tytułów na platformach YouTube, Kick, Steam i Discord.
• Lokalizację i adaptację materiałów promocyjnych na rynek polski.
• Ambasadorstwo polskie i reprezentację marki w społeczności graczy.

Szczegółowe warunki współpracy, wynagrodzenie oraz zakres usług są każdorazowo ustalane indywidualnie i dokumentowane w odrębnej umowie. Informacje o usługach zamieszczone w Serwisie nie stanowią oferty w rozumieniu Kodeksu cywilnego.

Wyłączenie odpowiedzialności

Administrator dokłada wszelkich starań, aby treści zamieszczone w Serwisie były rzetelne i aktualne. Niemniej:

• Serwis jest udostępniany w stanie „takim, jakim jest" — bez gwarancji kompletności ani ciągłości dostępu.
• Administrator nie ponosi odpowiedzialności za decyzje podejmowane przez Użytkownika na podstawie treści Serwisu.
• Administrator nie odpowiada za treści zewnętrznych serwisów, do których prowadzą linki zamieszczone w Serwisie.
• Administrator zastrzega sobie prawo do czasowego wyłączenia Serwisu w celach technicznych bez wcześniejszego powiadomienia.

Ochrona danych osobowych (RODO)

Administratorem danych osobowych przekazanych w korespondencji e-mail jest AgBi (Projekt Indie), adres kontaktowy: agbigamesstudio@gmail.com.

• Dane są przetwarzane wyłącznie w celu udzielenia odpowiedzi na zapytanie (podstawa: art. 6 ust. 1 lit. b i f RODO).
• Dane nie są udostępniane podmiotom trzecim ani wykorzystywane w celach marketingowych bez zgody osoby, której dotyczą.
• Użytkownikowi przysługuje prawo dostępu do danych, ich sprostowania, usunięcia oraz przenoszenia.
• Serwis nie stosuje plików cookies ani narzędzi analitycznych. W pamięci lokalnej przeglądarki (localStorage) zapisywana jest wyłącznie preferencja języka, niezbędna do prawidłowego działania Serwisu; informacja ta nie jest przekazywana Administratorowi.

W sprawach dotyczących danych osobowych należy kontaktować się pod adresem wskazanym powyżej.

Zmiany Regulaminu

Administrator zastrzega sobie prawo do zmiany niniejszego Regulaminu w dowolnym czasie. Zmiany wchodzą w życie z chwilą opublikowania zaktualizowanej wersji w Serwisie. Data ostatniej aktualizacji jest każdorazowo widoczna na górze dokumentu.

Dalsze korzystanie z Serwisu po wprowadzeniu zmian oznacza akceptację nowej treści Regulaminu.

Postanowienia końcowe i kontakt

W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy prawa polskiego, w szczególności ustawy z dnia 23 kwietnia 1964 r. — Kodeks cywilny oraz ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną.

Wszelkie spory wynikłe z korzystania z Serwisu będą rozstrzygane przez sąd właściwy dla miejsca zamieszkania Administratora. Postanowienie to nie wyłącza ani nie ogranicza praw Użytkownika będącego konsumentem, wynikających z bezwzględnie obowiązujących przepisów prawa.

General Provisions

These Terms of Service (hereinafter: the “Terms”) set out the rules for using the website available at projektindie.pl (hereinafter: the “Service”), operated by AgBi in the course of creative activity conducted under the name Projekt Indie.

Use of the Service constitutes acceptance of these Terms in their entirety. Persons who do not accept their provisions should refrain from using the Service.

Definitions

• Service — the AgBi website available at projektindie.pl, together with all its subpages.
• User — any natural person, legal person or organisational unit without legal personality visiting the Service.
• Administrator — AgBi, who operates the Service and is responsible for its content.
• Content — all textual, graphic, video and audiovisual materials published on the Service.
• Collaboration — creative activity, whether for remuneration or free of charge, performed for the benefit of third parties, as described on the Service.

Rules for Use of the Service

The User undertakes to use the Service in accordance with applicable law, generally accepted standards of conduct and these Terms.

In particular, the User shall not:

• reproduce, duplicate or distribute the Content without the Administrator's prior written consent;
• undertake any action liable to disrupt the proper functioning of the Service;
• engage in scraping, automated data collection or any other technical circumvention of the Service's security measures;
• use the Service for commercial purposes without the Administrator's prior consent;
• impersonate the Administrator or Projekt Indie in public.

Copyright and Intellectual Property

All Content published on the Service — including texts, graphics, logotypes, video recordings, descriptions, reviews and analyses — constitutes the intellectual property of the Administrator or of entities that have granted the relevant licences, and is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights.

• Quotation of excerpts of the Content is permitted, subject to the mandatory attribution of the source and authorship (AgBi / Projekt Indie).
• Opinions and game reviews published on the Service express the subjective viewpoint of the Administrator and may not be treated as marketing material without prior written consent.
• Logotypes and graphic marks of the indie game developers referred to on the Service remain the property of their respective owners.

Collaboration and Business Inquiries

The Administrator provides creative services to independent development studios and game publishers, including in particular:

• the preparation of reviews and analyses of indie games;
• the promotion of titles on the YouTube, Kick, Steam and Discord platforms;
• the localisation and adaptation of promotional materials for the Polish market;
• Polish ambassadorship and brand representation within the gaming community.

The detailed terms of any Collaboration, the remuneration and the scope of services are determined individually in each case and recorded in a separate agreement. Information about services published on the Service does not constitute an offer within the meaning of the Polish Civil Code.

Exclusion of Liability

The Administrator makes every effort to ensure that the Content published on the Service is accurate and up to date. Notwithstanding the foregoing:

• the Service is made available on an “as is” basis, without any warranty as to its completeness or the continuity of access thereto;
• the Administrator shall not be liable for any decisions taken by the User on the basis of the Content;
• the Administrator shall not be liable for the content of external websites to which links are provided on the Service;
• the Administrator reserves the right to suspend the Service temporarily for technical reasons, without prior notice.

Protection of Personal Data (GDPR)

The controller of personal data provided in e-mail correspondence is AgBi (Projekt Indie), contact address: agbigamesstudio@gmail.com.

• Personal data are processed solely for the purpose of responding to the inquiry submitted (legal basis: Article 6(1)(b) and (f) of the GDPR).
• Personal data are not disclosed to third parties, nor used for marketing purposes, without the consent of the data subject.
• The User has the right of access to their data, and the right to rectification, erasure and data portability.
• The Service does not use cookies or analytical tools. Only the User's language preference is stored in the browser's local storage (localStorage), as this is necessary for the proper functioning of the Service; that information is not transmitted to the Administrator.

Requests concerning personal data should be addressed to the Administrator at the address indicated above.

Amendments to the Terms

The Administrator reserves the right to amend these Terms at any time. Amendments shall take effect upon publication of the updated version on the Service. The date of the most recent update is displayed at the top of this document at all times.

Continued use of the Service following the introduction of any amendments constitutes acceptance of the amended Terms.

Final Provisions and Contact

In matters not governed by these Terms, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 — the Civil Code, and the Act of 18 July 2002 on Providing Services by Electronic Means.

Any disputes arising from the use of the Service shall be settled by the court having jurisdiction over the Administrator's place of residence. This provision neither excludes nor limits the rights of a User who is a consumer under mandatory provisions of law.
